IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, YOU MAY NOT ACCESS OR USE THE SITE AND SHOULD IMMEDIATELY CEASE SUCH USE. CoOwner Boats/RVs COULD MODIFY THIS AGREEMENT AT ANY TIME, SUCH MODIFICATIONS WOULD BE EFFECTIVE IMMEDIATELY. YOU AGREE TO REVIEW THE AGREEMENT REGULARLY TO BE AWARE OF SUCH MODIFICATIONS AND YOUR CONTINUED USE OF THE SITE SHALL DETERMINE YOUR ACCEPTANCE OF THE MODIFIED AGREEMENT.
YOU WILL NOT HOLD CoOwner Boats/RVs RESPONSIBLE FOR (I) ANY CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR INFORMATION, AND THE LIKE) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SERVICE, OR ANY INFORMATION, OR TRANSACTIONS PROVIDED ON THE SERVICE, OR DOWNLOADED FROM THE SITE OR ANY THIRD PARTY SITES OR ANY DELAY OF SUCH INFORMATION OR SERVICE, OR (II) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE SERVICE AND/OR MATERIALS OR INFORMATION DOWNLOADED THROUGH THE SERVICE. BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, CoOwner Boats/RVs LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
Also, you will not
hold CoOwner Boats/RVs responsible for users' actions or
inactions, including things they post. The Site is a venue to allow
anyone to consummate transactions involving goods offered on our site.
We are not involved in the actual transactions between Co-owners; We
have no control over and do not guarantee the quality, safety or legality
of Goods advertised, the truth or accuracy of listings, the ability
of a listing party to sell items, the ability of interested
co-owners to pay for items, or that an interested co-owner will actually
complete a transaction.
We cannot guarantee continuous or secure access to our services, and
operation of the Site may be interrupted or
interfered with by numerous factors outside of our control. Accordingly,
to the extent legally permitted, we exclude all implied warranties.
We are not liable for any loss of money, goodwill, or reputation, or
any special, indirect, or consequential damages arising out of your
use of our Site.
International and Domestic copyright and trademark laws protect the contents of this Site including the look and feel of the Site, color combinations, layout and other graphical elements. The owners of the intellectual content, copyrights, trademarks or service marks are Made in the Shade and CoOwner Boats/RVs.com, its affiliates or other third party licensors. YOU MAY NOT USE, MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE, ANY OF THE MATERIAL ON THE SITE, INCLUDING TEXT, GRAPHICS, CODE AND/OR SOFTWARE UNLESS OTHERWISE NOTED ON THE SITE.
You may print and download portions of material from the different areas of the Site solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials. You agree to grant to CoOwner Boats/RVs a non-exclusive, royalty-free, worldwide, sub licensable, perpetual license, with the right to sub-license, to reproduce, distribute, transmit, create derivative works of, publicly display any materials and other information you submit to any public areas of the Site by any means and in any media now known or hereafter developed. You also understand that CoOwner Boats/RVs cannot and does not guarantee or warrant that files available for downloading through the Site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

CoOwner Boats/RVs offers a service that brings together owners and prospective co-owners involving Boats and or RVs. All listing information about Boats and RVs on the Site, is supplied by our clients (Owner/Listers) and not by CoOwner Boats/RVs. When posting a listing you must adhere to all of the guidelines listed in this Agreement. The price and all other terms of any transaction remain subject to direct negotiation between the parties to the transaction only, in which CoOwner Boats/RVs has no involvement. We hope that all who visit our Site will act honorably and treat each other fairly. We cannot verify the accuracy of the information that (Owner/Listers) supply.
When you offer any Boat or RV through the Site, you must be prepared
to provide the vehicle upon the terms on which you have listed it. To
list vehicles on the Site, (Owner/Listers) are required to provide certain
identifying and contact information. The information must accurately
identify the (Owner/Lister) and the method of contact must permit interested
parties to communicate directly with the (Owner/Lister). You may not
use our Site to promote, without our prior written permission, any other
Web site, product or service. CoOwner Boats/RVs reserves the right to
deny use of the Site to anyone who does not comply with these requirements
or who otherwise uses our Site in a manner we consider inappropriate.
Responsibility for accurate information contained in listings lies solely
with each (Owner/Lister). You alone are responsible for the material
you post and for the content, including, without limitation, all e-mail
messages transmitted through the Site.
By submitting a listing through our advertising service, you agree to
pay the fees (in US currency) specified for the listing package regardless
of whether you are successful in consummating a transaction as a result
of the listing. Listing fees are generally not refundable.
We retain the right to deny access to anyone who we believe has violated
these terms or any other term of this agreement. We may occasionally
have to release information when it is appropriate to comply with the
law (including disclosure in response to a request from a law enforcement
agency) to enforce Coowner Boats/Rvs Terms of Use, Privacy Policy or
to protect the rights, property or safety of visitors to our Site. We
reserve the right to reject any ad copy. All orders are subject in all
respects to our current rules and regulations.
ALL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE AND THE INTERNET ARE YOURS. You agree to indemnify, defend and hold harmless CoOwner Boats/RVs, its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the Site from and against all losses, expenses, damages and costs, including attorneys' fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or your use and access of the Site.
CoOwner Boats/RVs reserves the right to release current or past member or Web site user information if CoOwner Boats/RVs believes that a member's account is being used to commit unlawful acts, if the information is subpoenaed and/or if CoOwner Boats/RVs deems it necessary and or appropriate.
The provisions of paragraphs
2 (Use of the Site), and 4 (Indemnification) are for the benefit of
CoOwner Boats/RVs and its officers, directors, employees, agents, licensors,
suppliers, and any third party information providers to the Site. Each
of these individuals or entities shall have the right to assert and
enforce those provisions directly against you on its own behalf.
All participation, correspondence or business dealings that you have with any third party found on or through the Site, regarding the payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such third party. You agree that CoOwner Boats/RVs shall not be responsible or liable for any loss, damage or other matters of any sort incurred as the result of any such dealings.
CoOwner Boats/RVs may provide, or third parties may provide, links to World Wide Web sites or resources. Because CoOwner Boats/RVs has no control over such sites and resources, you understand and agree that CoOwner Boats/RVs is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any content, advertising, products, or other materials on or available from such sites or resources. Furthermore you acknowledge and agree that CoOwner Boats/RVs shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such site or resource. Because of the global nature of the Internet, you agree to comply with all local rules including, without limitation, rules about the Internet, data, e-mail, or privacy. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the United States or the country in which you reside.
This Agreement shall all be governed and construed in accordance with the laws of the State of Idaho, United States of America and applicable to agreements made and to be performed in the State of Idaho, USA. You agree that any legal action or proceeding between CoOwner Boats/RVs and you for any purpose concerning this Agreement or the parties obligations hereunder shall be resolved by a court of jurisdiction in the City of Sandpoint, State of Idaho. for the purpose of litigating all such claims or disputes. Some rights not expressly granted herein are reserved.
